Posted: Wed Jun 08, 2011

The football club is currently waiting for Keith Haslam and Stags Limited to file a defence to its counter claim in respect of unlawful dividends, loans to directors and related parties , termination payments to directors and breaches of directors' duties. The deadline for filing the defence is the end of this month.

Stags Limited issued possession proceedings in the Mansfield County Court against the football club in respect of Field Mill. The football club is defending these proceedings and counter claiming for around £3 million in respect of unlawful dividends, loans to directors and related parties , termination payments to directors and breaches of directors' duties. They have also added Keith Haslam to the proceedings as some of the club's claims are against him personally and not his company, Stags Limited. The case has now been transferred to the Commercial Court in Birmingham. Essentially all the parties' claims against each other have been joined together in one single case.

The football club is also arguing that Stags Limited holds Field Mill on trust for the football club. They are asking the court to make an order requiring Stags Limited to transfer Field Mill back to the football club.

Q: What happens if a defence is not filed by the end of the month ?

The club can apply to the court for a summary judgment i.e. a judgment in favour of the football club
